NON-TRANSFERABLE LIMITED WARRANTY

Subject to the limitations set forth herein, Westfield Outdoor, Inc., a Nevada corporation, (“Westfield”) warrants to the original purchaser (the “Purchaser”) that for a period of one year from the date of shipment (the “Warranty Period”) of any Timber Ridge Product, TR/TRT product, Old Bahama Bay Product, Portal Product, Busy Bee Product, or Power Ridge Product (the “Products“), that such Products will be free from material defects in workmanship (unless specified otherwise) (the “Limited Warranty”). For the avoidance of doubt, normal wear and tear is expected and not covered under the Limited Warranty. The Limited Warranty not does apply to fabric and bungee cords, product preferences (such as color or a specific feature), size or fit of an item, and replacement items.

Items manufactured by a third party (“Third Party Product”) may contain, be contained in, incorporated into, attached to or packaged together with the Products. Third Party Products are not covered by the Limited Warranty set forth above. For the avoidance of doubt, Westfield makes no representations or warranties with respect to any Third Party Product.

EXCEPT FOR THE LIMITED WARRANTY SET FORTH ABOVE, WESTFIELD MAKES NO WARRANTY WHATSOEVER WITH RESPECT TO THE PRODUCTS, INCLUDING ANY (i) WARRANTY OF MERCHANTABILITY, (ii) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, (iii) WARRANTY OF TITLE, OR (iv) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE.

Westfield shall not be liable for a breach of the Limited Warranty unless: (i) the Product was purchased from a current authorized dealer, (ii) the Purchaser produces a valid proof of purchase for the Product (i.e., a valid dated receipt from the place of purchase), (iii) the Purchaser gives written notice of the defect, reasonably described, to Westfield within 30 days of the time when the Purchaser discovers or ought to have discovered the defect, (iv) Westfield is given a reasonable opportunity after receiving the notice to examine such Product and Purchaser (if requested to do so by Westfield) returns such Product to Westfield’s place of business at Westfield’s cost for the examination to take place there; (v) Westfield reasonably verifies Purchaser’s claim that the Product is defective; and (vi) Purchaser follows the process for claiming a defect set forth below.

Westfield shall not be liable for a breach of the Limited Warranty set forth above if: (i) Purchaser makes any further use of such Product after giving such notice; (ii) the defect arises because the Purchaser failed to follow Westfield’s oral or written instructions as to the storage, installation, commissioning, use (including weight limits, if any) or maintenance of the Product; (iii) the Purchaser attempts to alter or repair such Product without the prior written consent of Westfield or hires a third party to alter or repair such Product, (iv) the Product was purchased through a non-authorized source (such as auction houses, third party vendors, liquidation houses, garage sales, closeout retailers and third-party web sites), or (v) the defect arises by an act of God.

With respect to any defective Products covered by the Limited Warranty during the Warranty Period, Westfield shall, in its sole discretion, either: (i) repair or replace such Products (or the defective part) or (ii) credit or refund the price of such Products. Please note that because Westfield anticipates continual updates and improvement to the Product line, Westfield may or may not have the exact item in stock to replace the Product. Westfield reserves the right to send a product of similar quality and function to satisfy the warranty claim. THE REMEDIES SET FORTH IN THIS PARAGRAPH SHALL BE THE PURCHASER’S SOLE AND EXCLUSIVE REMEDY AND WESTFIELD’S ENTIRE LIABILITY FOR ANY BREACH OF THE LIMITED WARRANTY.

Warranty By Brand

Unless otherwise stated, every product, regardless of brand, will have a 1-year limited warranty, with the exception being for all Power Ridge® products, which will have a 2-year limited warranty. 

Process for Claiming a Defect: Amazon Orders

If the Product was purchased on Amazon.com, the Purchaser will need to follow Amazon.com’s return policy by logging into his, her or its Amazon.com account. Westfield is unable to process any warranty claims for items purchased through Amazon.com.

Process for Claiming a Defect: Non-Amazon Orders

For all other warranty claims, please email CharlieTimberRidge@westfieldoutdoors.com using the subject line of:  “Warranty Claim; ______, 20__” (inserting the then current date). Please do not call our office. The email shall include the following: (i) the Purchaser’s name, address and daytime phone number, (ii) the name of the Product, item number and where it was purchased, (iii) a description of the alleged defect, (iv) photographs of the Product and the alleged defect, and (v) a copy of the proof of purchase.

A Westfield representative will contact the Purchaser and issued a warranty claim number. Purchaser shall keep this warranty claim number at hand and refer to it at all times during the warranty review process. Failure to meet any of the above will result in your claim being rejected.
